The necessity of the emphasis of the brain death to the whol medical society made us to reexamine this topic in the following order. A. Scientffic and medical dimension of the death: The definition of the brain death, The basic signs of the irreversible brain damage, The observation and the criteria for the sound definition of the brain death, When the decision is giyen as the brain death at the end of the evaluation: The connecting procedures with organ and tissue transplantation, The decision to end the medical support or not in case the permission can't be obtained from the relatives of the patient for the transplantation. B. Legal definition of the brain death and the code of law and the forensic medicine rules: 17/09/92 "The Transplantation Coordination Study Plan" is sent to the hospital administrators by the General Management, Treatment Services, Ministry of Health, 16110192 the newspaper "Cumhuriyet", in the column "Events and Comments" this subject titled "Organ and Tissue Transplantation" is argued form the point of forensic medicine and religion, 20108193 issued in Legal Newspaper dated 29/05/79 numbered 2238 and dated 21101182 numbered 2594 the change and addition of law. C. The religious and moral aspects of the brain death: Turkish Republic Religious Administration dated 03/03/80 numbered 396 titled "Organ Transplantation".
